Terms of Service (FSMeet)

Hinweis: Diese Bedingungen sind in deutscher und englischer Sprache verfügbar. Im Falle von Widersprüchen oder Auslegungsfragen ist die deutsche Version maßgeblich.

1. Allgemeines

Diese Nutzungsbedingungen ("Bedingungen") regeln die Nutzung der Plattform FSMeet ("Plattform"). Mit der Nutzung der Plattform erklärst du dich mit diesen Bedingungen einverstanden.

2. Leistungsbeschreibung

FSMeet ist eine Plattform, auf der Event Hosts Events erstellen und verwalten können. Teilnehmer können sich für Events anmelden. Zusätzlich bietet die Plattform kostenpflichtige Features (Pro-Lizenzen), Werbeplätze sowie Zahlungsabwicklung für Eventteilnahmen über Drittanbieter (z. B. Stripe).

3. Accounts

• Für die Nutzung ist ein Account erforderlich.
• Nutzer sind für die Sicherheit ihrer Zugangsdaten verantwortlich.
• Profile enthalten sowohl öffentliche als auch private Informationen.
• Öffentliche Profilinformationen (z. B. Name, Profilbild, Alter, Social Links) sind weltweit sichtbar.
• Standortdaten (Latitude/Longitude) werden nur veröffentlicht, wenn der Nutzer dies aktiv freigibt.
• Es besteht kein Anspruch auf exakte Standortdaten.
• FSMeet kann Standortdaten zum Schutz der Nutzer (insbesondere Minderjähriger) technisch verändern.

4. Inhalte von Nutzern

• Nutzer können Inhalte wie Texte, Bilder und Dokumente hochladen.
• Nutzer behalten die Rechte an ihren Inhalten.
• Mit dem Upload räumen Nutzer FSMeet ein nicht-exklusives, weltweites Nutzungsrecht zur Darstellung und zum Betrieb der Plattform ein.
• FSMeet kann Inhalte jederzeit entfernen.

5. Events und Teilnahme

• Event Hosts sind die alleinigen Veranstalter ihrer Events.
• FSMeet ist nicht Veranstalter und übernimmt keine Verantwortung für Durchführung oder Organisation.
• Teilnehmer melden sich eigenverantwortlich an.
• FSMeet übernimmt keine Garantie für Events.
• Für Events können zusätzliche Daten (z. B. Geburtstag, Telefonnummer, Kleidergrößen) erhoben werden.
• Diese werden an den Event Host weitergegeben.
• Der Host darf diese ausschließlich zur Eventdurchführung nutzen.

6. Zahlungen

• Zahlungen werden über Drittanbieter (z. B. Stripe) abgewickelt.
• Unterschiedliche Zahlungsmethoden können unterschiedliche Gebühren verursachen.
• Der Vertrag entsteht zwischen Teilnehmer und Event Host.
• FSMeet erhebt zusätzlich eine Plattformgebühr (aktuell bis zu 2%).
• Die Plattformgebühr kann angepasst werden.
• Gebühren können vom Host getragen oder vollständig an Teilnehmer weitergegeben werden.
• Teilnehmer können optional zusätzliche Beiträge leisten.
• Zusätzliche Stripe-Kosten daraus werden dem Host gutgeschrieben.
• Refunds erfolgen primär durch den Host.
• FSMeet kann im Streitfall Zahlungen ganz oder teilweise erstatten.
• FSMeet übernimmt keine Haftung für Zahlungsstreitigkeiten.

7. Werbung

• Werbeplätze werden für 30 Tage gebucht.
• Kein Anspruch auf Reichweite, Performance oder exakte Platzierung.
• Layout kann sich ändern.
• Keine Rückerstattung.
• Bei längeren Ausfällen kann die Laufzeit verlängert werden.
• FSMeet kann Werbung ablehnen oder entfernen.

8. Visa Invitation Letters

• Können über die WFFA ausgestellt werden.
• Kein Rechtsanspruch.
• Ausstellung erfolgt nach Prüfung.
• Keine Garantie auf Anerkennung.

9. API und Drittanbieter

• FSMeet kann eine öffentliche API bereitstellen, die von Drittanbietern genutzt werden kann.
• Anwendungen und Services von Drittanbietern stehen in keiner Verbindung zu FSMeet und unterliegen nicht der Kontrolle von FSMeet.
• FSMeet übernimmt keine Verantwortung für Inhalte, Funktionalität oder Datenschutzpraktiken von Drittanbieter-Anwendungen.
• Die Nutzung solcher Anwendungen erfolgt auf eigenes Risiko des Nutzers.
• Die Nutzung der API zu kommerziellen Zwecken (z. B. kostenpflichtige Apps, Werbung, Weiterverkauf von Daten oder Services) ist nur mit ausdrücklicher Zustimmung von FSMeet erlaubt.
• FSMeet behält sich das Recht vor, den Zugriff auf die API jederzeit einzuschränken, zu ändern oder zu beenden.

10. Nutzungsregeln

Verboten sind:

• illegale Inhalte
• Spam
• Verletzung von Rechten Dritter
• Missbrauch (z. B. Betrug, Fake Events)

11. Haftung und Verfügbarkeit

• FSMeet bemüht sich um hohe Verfügbarkeit, garantiert diese jedoch nicht.
• Keine Haftung für Ausfälle, Unterbrechungen oder Datenverlust.
• Keine Haftung für Nutzerinhalte.
• Keine Haftung für Events oder Zahlungen.
• Haftung nur bei Vorsatz und grober Fahrlässigkeit.

12. Sperrung und Kündigung

Accounts können bei Verstößen oder Missbrauch gesperrt oder gelöscht werden.

13. Änderungen

• Änderungen sind jederzeit möglich.
• Nutzer werden informiert.
• Ohne Widerspruch gelten Änderungen als akzeptiert.
• Bei Widerspruch kann FSMeet das Nutzungsverhältnis beenden.

14. Anwendbares Recht

Es gilt deutsches Recht.

1. General

These Terms of Service ("Terms") govern the use of the FSMeet platform ("Platform"). By using the Platform, you agree to these Terms.

2. Service Description

FSMeet is a platform where event hosts can create and manage events. Participants can register for events. The platform also offers paid features (Pro licenses), advertising placements, and payment processing for event participation via third-party providers (e.g. Stripe).

3. Accounts

• Use of the Platform requires an account.
• Users are responsible for maintaining the security of their login credentials.
• Profiles may contain both public and private information.
• Public profile information (e.g. name, profile picture, age, social links) is visible worldwide.
• Location data (latitude/longitude) is only published if the user explicitly enables it.
• There is no entitlement to the display of exact location data.
• FSMeet may technically modify location data to protect users (especially minors), preventing precise identification of residential addresses.

4. User Content

• Users may upload content such as text, images, and documents.
• Users retain ownership of their content.
• By uploading content, users grant FSMeet a non-exclusive, worldwide right to use such content for operating and displaying the Platform.
• FSMeet reserves the right to remove content at any time.

5. Events and Participation

• Event hosts are the sole organizers of their events.
• FSMeet is not an event organizer and assumes no responsibility for the execution or organization of events.
• Participants register for events at their own responsibility.
• FSMeet does not guarantee that events will take place.
• Additional data (e.g. date of birth, phone number, clothing sizes) may be collected during event registration.
• This data is shared with the respective event host.
• Event hosts may use this data exclusively for the execution of the event.

6. Payments

• Payments are processed via third-party providers (e.g. Stripe).
• Different payment methods may result in different fees.
• The contract for event participation is concluded solely between the participant and the event host.
• FSMeet charges an additional platform fee (currently up to 2%).
• FSMeet reserves the right to adjust the platform fee.
• Fees may be borne by the event host or fully passed on to participants.
• Participants may optionally add additional contributions during checkout.
• Any additional payment provider costs resulting from such contributions are credited to the event host.
• Refunds are primarily handled by the event host.
• FSMeet reserves the right to issue full or partial refunds in case of disputes.
• FSMeet assumes no liability for payment disputes.

7. Advertising

• Advertising placements are booked for a fixed period of 30 days.
• There is no entitlement to specific reach, performance, or exact placement.
• Display and layout may change.
• Fees are non-refundable.
• In case of extended downtime, the duration of advertising placements may be extended accordingly.
• FSMeet reserves the right to reject or remove advertisements.

8. Visa Invitation Letters

• Visa invitation letters may be issued via the WFFA upon request.
• There is no legal entitlement to issuance.
• Issuance is subject to review.
• FSMeet does not guarantee acceptance by authorities.

9. API and Third-Party Services

• FSMeet may provide a public API that can be used by third parties.
• Third-party applications and services are independent from FSMeet and are not under FSMeet's control.
• FSMeet assumes no responsibility for the content, functionality, or data practices of such third-party applications.
• Use of such applications is at the user's own risk.
• Use of the API for commercial purposes (e.g. paid applications, advertising, resale of data or services) requires prior explicit consent from FSMeet.
• FSMeet reserves the right to restrict, modify, or terminate API access at any time.

10. Acceptable Use

The following is prohibited:

• illegal content
• spam
• violation of third-party rights
• misuse of the platform (e.g. fraud, fake events)

11. Liability and Availability

• FSMeet strives to maintain high availability but does not guarantee uninterrupted service.
• FSMeet is not liable for outages, interruptions, or data loss.
• FSMeet is not liable for user-generated content.
• FSMeet is not liable for events or payments.
• Liability is limited to intent and gross negligence.

12. Suspension and Termination

Accounts may be suspended or deleted in case of violations or misuse.

13. Changes

• FSMeet may modify these Terms at any time.
• Users will be informed accordingly.
• Continued use without objection is considered acceptance of the changes.
• In case of objection, FSMeet may terminate the user relationship.

14. Governing Law

The laws of the Federal Republic of Germany apply.
